Moore, Clarke, DuVall & Rodgers, P.C. handles creditor representation in both commercial and consumer bankruptcy cases. The firm represents banks, agricultural lenders, and other commercial lenders in cases filed under Chapters 7, 11, 12 and 13 of the United States Bankruptcy Code. Additionally, our lawyers have experience representing Creditors Committees and Trustees appointed in bankruptcy cases. Our attorneys are admitted to practice in the Middle, Southern, and Northern Districts of Georgia, the Northern and Middle Districts of Florida, and the Middle District of Tennessee and frequently participate in cases filed in each of those districts.

Inevitably, diverse, non-bankruptcy issues arise in bankruptcy matters. Moore, Clarke, DuVall & Rodgers, P.C. is one of the few firms in South Georgia representing creditors in bankruptcy cases which also has lawyers specialized in other areas of the law which arise during the course of a complicated case. Moore, Clarke, DuVall & Rodgers, P.C. is able to provide the same level of expertise as larger regional firms at a much lower cost by utilizing the resources of the practice groups within the firm.

Lawyers in the Business, Banking and Commercial Law Group have extensive experience in Commercial Bankruptcy cases. This experience includes, but is by no means limited to the following:

  • Representing secured and unsecured lenders in the negotiated reorganization of the debtor in Chapter 11 and Chapter 12 cases;

  • Protecting secured lenders' interest in their collateral;

  • Defending the interest of creditors in actions filed by a Trustee of a Chapter 11 Debtor;

  • Providing representation to committees of unsecured creditors in Chapter 11 cases;

  • Representing creditors in actions to determine the dischargeability of their claim and in efforts to deny the debtor a discharge in bankruptcy; and

  • Representing secured and unsecured lenders seeking the appointment of a Trustee in a Chapter 11 case.

In addition to commercial bankruptcy case, the Business, Banking and Commercial Law Group represents creditors in consumer bankruptcy cases. Although these bankruptcy cases are less complicated than bankruptcy reorganization cases, they arise much more frequently. We provide prompt, efficient representation of our clients in each of these cases. Some of the myriad on consumer-related bankruptcy matters handled by our Business, Banking and Commercial Law Group includes:

  • Representing secured and unsecured lenders in protecting their interest in collateral,

  • Assisting secured creditors in obtaining relief from the automatic stay to pursue their collateral interests,

  • Assuring creditors the optimal treatment of their claims in the bankruptcy process, and

  • Where appropriate, representing creditors in seeking to deny the debtor a discharge in bankruptcy.

The Local Bankruptcy Rules of each court district differ significantly.  Some of the Local Bankruptcy Rules require immediate action at the beginning of a case. Because our Business, Banking and Commercial Law Group provides representation to Creditors, Trustees, and Creditor's Committees in Bankruptcy Courts throughout Georgia's three Federal Court Districts, we are familiar with the rules of practice and procedure in each district.
